The Failure of the 28-Article Peace Proposal for Ukraine: Why Diplomatic Efforts Continue to Falter

Europe experienced widespread relief on Monday, as the tension triggered by the announcement of a new comprehensive peace framework for resolving the conflict appeared – temporarily – to have been stabilised. A Washington representative spoke of "notable headway" after Ukraine-US talks in Geneva. On Monday night, the Kremlin made its retaliation: a renewed assault of rocket attacks on Kyiv.

The Cycle of Peace Talks and Military Action

The chain of opposing developments captured the harsh reality of the recent timeframe. By day, diplomatic battles are fought: optimistic declarations are issued from multiple capitals. Significant resources is expended on containing certain initiatives. By night, the Kremlin clearly shows the world that, for them, war remains the main instrument for achieving "peace".

After-Dark Attacks

As military strikes progressed into the early hours of Tuesday, the present situation of Ukraine's defenselessness was revealed. Ukraine is able to track rocket firings from enemy soil, a capability provided through timely intelligence. From vantage locations, defense planes that had been deployed to counter approaching cruise missiles streaked across the sky – modern combat jets delivered to Ukraine by NATO members.

Soon thereafter, Kyiv's air-defence systems activated: defensive missiles fired to intercept a hostile projectile. This was a modern interception technology at work, presumably supplied through partner states. Every deployment creates sudden vibrations, causing tremors. The moment of terror quickly becomes grim resignation: possibly the hostile projectile won't cause damage this time, protecting urban areas from catastrophe and additional electricity failures.

Ongoing Risks

Following this, a heavy machine gun opened up on a aerial vehicle somewhere nearby, part of a rapid response unit – most likely Western-made equipment. Unfortunately, the projectiles didn't strike the enemy aircraft – it maintained course toward its target.

Periodically, this carried on until dawn. Kyiv greeted the morning news: several casualties, destruction and infrastructure problems in many homes as a result of the night's assault. As customarily, everyone still maintained normal activities – living the war. But those full day demonstrated Ukraine's vital need on Western support – a need that neighboring countries are evidently unprepared to substitute in the short term.

Failed Diplomacy

The detailed framework from American leadership generated strong feelings, controversy and serious worry – and momentarily shifted focus from Ukraine's largest corruption scandal in years. Yet, we have witnessed similar scenarios, after earlier high-level meetings and international summits.

Every new initiative from US leadership follows the identical sequence: a negotiation push against Ukraine, which Kyiv, with other European capitals, effectively counters. They manage the tension but never actually achieve victory. This pattern will, no doubt, continue.

Strategic Calculations

It is tempting to accuse particular leaders of persistently promoting Moscow's conditions. But that does not seem to be the complete picture. American leadership functions according to a principle well known to experienced diplomats: you cannot win at the negotiating table what you have been unable to protect through force. The US administration believes that it is impossible to pressure the Kremlin to relinquish the territory that it already controls in Ukraine's occupied territories.

The challenge is that while recognising this factual reality, American administration does minimal to discourage Russia, through statements or actions, from assuming that the current condition will not change more in its advantage in the near future.

Opposing Positions

Therefore, Moscow is certain that duration works to their advantage – that Ukraine and its partners are approaching exhaustion. Their reason to accept conditions that does not give them the largest achievable advantage is close to zero. There may be multiple initiatives to stop fighting, but they will carry on as long as Russia's government remains supremely confident in the result.

On the contrary, Ukraine's government believes that Ukraine can still hold out, gradually sacrificing civilians and areas but avoiding a total frontline collapse until situations evolve in its favour.

Present Conditions

Objectively, there are no real preconditions for a ceasefire. Now, individual motivations are coming into play: political desires to broker a ceasefire and secure international recognition, and Ukrainian leadership's dual difficulties – on one hand, not to distance important partners, and on the other, to unite the population around the flag against any initiative Kyiv finds unacceptable, so that their priority does not switch to internal issues. And although their objective will now be significantly challenging after latest incidents, it remains quite doubtful that this will alter their fundamental strategy.

These conflicting dynamics are driving the talks.

Assessment and Future

It took a only one week to terminate the 28 points of the current initiative. Aggressive and erratic handling of the matter by US administration, pushback by Ukraine and the remaining European nations, along with calming attempts of representatives, and finally, current information leaks, all achieved their purpose.

While new proposals based on old ideas are forthcoming, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are rooted in Kremlin requirements and demonstrate specific hesitation to modify developments, if they remain united and strengthen their defence capabilities at a significantly accelerated rate. If they do, neither political nor armed coercion will be able to defeat them. In the meantime, Ukraine's capacity to counter nocturnal attacks will, for the foreseeable future, primarily depend on ongoing international assistance.
